REGULATORY UPDATE

U.S. EPA Amends the Integrated Iron and Steel Manufacturing NESHAP

On May 20, 2003, U.S. EPA published National Emission Standards for Hazardous Air Pollutants (NESHAP) for Integrated Iron and Steel Manufacturing Facilities at 40 CFR Part 63, Subpart FFFFF.  This NESHAP applies to emission sources at new and existing sinter plants, blast furnaces, and basic oxygen process furnace shops.  Several steel companies and one trade association challenged portions of the final standards and petitioned for a review of the rule.  On July 13, 2006, U.S. EPA amended the NESHAP in response to the petition.  Amendments include a new compliance option, revision of emission limitations, reduction of the frequency of repeat performance tests for certain emission units, addition of corrective action requirements, and clarification of monitoring, recordkeeping, and reporting requirements.  For further information, refer to the Federal Register Notice or contact Steve Felton at (800) 229-5299

U.S. EPA Amends the Miscellaneous Organic Chemical Manufacturing NESHAP (MON)

On November 10, 2003, U.S. EPA published National Emission Standards for Hazardous Air Pollutants (NESHAP) for Miscellaneous Organic Chemical Manufacturing Facilities at 40 CFR Part 63, Subpart FFFF.  This NESHAP applies to producers of specialty organic chemicals, explosives, certain polymers and resins, and certain pesticide intermediates.  Several chemical manufacturing companies and trade associations challenged portions of the final standards and petitioned for a review of the rule.  On July 14, 2006, U.S. EPA amended the NESHAP in response to the petition.  Amendments clarify the applicability of Subpart FFFF, document the extension of the compliance date for existing sources to May 10, 2008, provide additional compliance options, modify compliance requirements, and simplify recordkeeping and reporting requirements.  For further information, refer to the Federal Register Notice or contact George Mesing at (724) 775-2910

Ohio EPA Issues Long-Awaited Industrial Storm Water General Permit

On June 1, 2006, Ohio EPA issued its renewed industrial storm water general permit (OHR000004).  The permit expires May 31, 2011.  Permit OHR000004 is a renewal of Permit OHR000003, which expired July 31, 2005.  Facilities that held industrial storm water general permit OHR000003 will have 90 days from the date of their renewal letter from Ohio EPA to prepare and submit a notice of intent (NOI) to be covered under the new general permit.  The fee is $350.  If Ohio EPA does not receive the NOI within 90 days of the date of the Ohio EPA renewal letter, coverage will automatically terminate per Attachment 1E of OHR000003.  For further information, refer to Permit OHR000004, or contact Mike Arozarena or Tim Hilgeman at (800) 229-7495.

EQ Responds at Emergency Radiological Site

As a member of U.S. EPA Region 9’s Emergency Response Team, EQ recently completed a cleanup and removal project involving radioactive materials at the Chino Airport in San Bernardino County, California.  Vintage radium-containing aircraft gauges were illegally stored in several aircraft hangars at the site.  Three hangars were investigated.  Workers collected wipe samples and air samples which were analyzed for radon and other types of radiation.  Mitigation measures were implemented and the site was secured.  U.S. EPA was able to initiate much of the cleanup without the use of government funds.  However, EQ was requested to remobilize and repack the radium-containing aircraft gauges and ship the waste offsite for disposal.  This action saved tens of thousands of dollars.  This site work was related to another recent EPA Removal Action in Los Angeles where EQ characterized, packaged, and removed over 1 million vintage gauges containing radionuclides.  For more information on this project contact Ron McManamy at (888) 673-2900.
