REGULATORY UPDATE

EPA Promulgates Proposed NSPS for Stationary Spark Ignition Internal Combustion Engines and Proposed NESHAP for Reciprocating Internal Combustion Engines

On June 12, 2006, U.S. EPA published proposed New Source Performance Standards (NSPS) for stationary spark ignition (SI) internal combustion engines (ICE).  The proposed NSPS would be promulgated under 40 CFR Part 60, Subpart JJJJ.  The proposed NSPS would regulate nitrogen oxides, carbon monoxide, and non-methane hydrocarbons from new, modified, and reconstructed stationary SI engines.  In addition, a sulfur limit on gasoline is being proposed.  The rulemaking also included proposed National Emission Standards for Hazardous Air Pollutants (NESHAPS) for stationary reciprocating ICE that are either located at area sources of Hazardous Air Pollutants (HAPs), or are located at major sources of HAPs but are less than or equal to 500 brake horsepower (bhp).  The proposed NESHAP would be promulgated under 40 CFR Part 63 Subpart ZZZZ which already contains standards for stationary reciprocating ICE above 500 bhp located at major HAP sources.  The proposed NESHAP would apply to existing, new, and reconstructed units, and would limit HAP emissions through emission standards for non-methane hydrocarbons and formaldehyde.  Carbon monoxide emission reductions are proposed as a surrogate for HAP emissions reductions.  For further information, refer to the Federal Register Notice, or contact Jeff Slayback at (800) 229-7495.  [NOTE: The Federal Register link has been corrected.]

NAICS Codes to be Used for TRI Reporting

On June 6, 2006, U.S. EPA issued a final rule mandating the use of North American Industry Classification System (NAICS) codes in Toxic Release Inventory (TRI) reporting.  The rule takes effect August 5, 2006, and will apply to TRI reports submitted by July 1, 2007 for the 2006 calendar year.  The action follows the White House’s Office of Management and Budget’s (OMB) decision to adopt the NAICS system to standardize industrial statistics with Canada and Mexico.  Standard Industrial Classification (SIC) codes will remain in the regulations as the basis for determining if a facility is subject to TRI reporting requirements, but NAICS codes will be used on the reporting forms.  The only policy change evolving from this transition pertains to the treatment of certain auxiliary establishments.  According to U.S. EPA, it is possible that some auxiliary establishments that were subject to TRI reporting requirements in the past may be exempt under the new rule.  For more information, please refer to the Federal Register Notice, or contact Sheri Bussard at (800) 229-7495.

PROJECT HIGHLIGHT

EQ Managing Tank Removal at Former Naval Installation Fuel Farm

In April 2006, EQ’s Seattle Washington office began a project involving the removal of abandoned aboveground oil storage tanks and related contaminated materials at the former Naval Tanapang Fuel Farm (TFF) in Saipan, Commonwealth of the Northern Mariana Islands (CNMI).  EQ is the emergency response coordinator for U.S. EPA Region 9 and is acting in cooperation with CNMI’s Division of Environmental Quality (DEQ) and the U.S. Army Corps of Engineers (USACE).  Scrap metal from the tanks is being recycled off site, and oil-contaminated soils are being landfilled off site.  Future actions will include addressing the possible contamination of groundwater on site.
