Hazardous Air Pollutant Emission Standards For Industrial, Commercial, and Institutional Boilers and Process Heaters
On September 13, 2004, the US Environmental Protection Agency (EPA) published final National Emission Standards for Hazardous Air Pollutants (NESHAPS) for Industrial, Commercial, and Institutional Boilers and Process Heaters (ICIBPH) (40 CFR Part 63, Subpart DDDDD). The effective date is November 12, 2004, and compliance with the rules by affected existing sources is required by September 13, 2007. This fact sheet is intended to assist potentially affected sources in determining whether they are subject to the rules, how sources can avoid applicability by securing a State air permit, and control technology options for reducing emissions.

Final Revisions To The Prevention Of Significant Deterioration and Nonattainment New Source Review Rules
On December 31, 2002, the U.S. Environmental Protection Agency (EPA) published final changes to its rules governing the construction or modification of major sources in areas attaining the National Ambient Air Quality Standards (NAAQS) [i.e., the prevention of significant deterioration (PSD) rules at 40 CFR 52.21] and in nonattainment areas [Nonattainment New Source Review (NNSR)].
These controversial rule changes relate largely to the applicability provisions for modifications at existing sources and provide sources a variety of mechanisms for avoiding PSD or NNSR not previously available.

Best Available Retrofit Technology Determinations Under The Regional Haze Rule
On July 1, 1999, the U.S. Environmental Protection Agency (EPA) promulgated regional haze rules to remedy visibility impairment from air pollution in 156 national parks and wilderness areas throughout the country (known as Class I areas). Under these rules, States must require certain older, large facilities to install the best emission control available, known as best available retrofit technology (BART), to control pollutants that contribute to visibility degradation. The pollutants affected are particulate matter (PM), sulfur dioxide (SO2), nitrogen oxides (NOx), volatile organic compounds (VOC), and ammonia (NH3). The latter four pollutants affect visibility primarily due to atmospheric transformation from gases to fine particulate on a regional scale.
On July 6, 2005, EPA promulgated final amendments to the regional haze rule to provide guidelines to States in making their BART determinations. The BART determinations must be submitted to EPA for review and approval by no later than December 17, 2007. The amendments provide guidelines for States to use in determining which facilities must install controls and the type of controls they must use. They also provide guidance for States to use in considering other factors, such as cost and impact on energy, as they determine the facilities to be controlled. [Updated July 2005]

Hazardous Air Pollutant Emission Standards For Lime Manufacturing Plants
On January 5, 2004, the US Environmental Protection Agency (EPA) promulgated National Emission Standards for Hazardous Air Pollutants (NESHAPS) for Lime Manufacturing Plants (LMP) (40 CFR Part 63, Subpart AAAAA). Compliance with the rules by affected existing sources will be required 3 years from the date of final promulgation (i.e., by January 5, 2007).

Proposed New Source Review Rules for PM2.5
On November 1, 2005, the U.S. Environmental Protection Agency (EPA) proposed rules for States to follow in developing State Implementation Plans (SIPs) to implement the National Ambient Air Quality Standards (NAAQS) for fine particles (PM2.5). One of the elements of the PM2.5 SIP’s (generally due to EPA in April 2008) involves requirements for major new or modified sources in both nonattainment (NA) areas and attainment/unclassified areas [i.e., Prevention of Significant Deterioration (PSD) areas].
This Fact Sheet is intended to assist sources that may be affected by the rules to understand the significant new impacts (compared to the existing requirements for major PM or PM10 sources) and to begin planning for implementation of the new rules.
